WHEREAS, the South Carolina Technology Advisory Council was established by the undersigned on March 5, 1996 in Executive Order Number 96-05; and

WHEREAS, the undersigned has determined that Executive Order Number 96-05 must be modified in certain particulars.

NOW, THEREFORE, by virtue of the powers conferred upon me by the Constitution and the Statutes of the State of South Carolina, Section 2 of Executive Order Number 96-05 shall be modified as follows:

d. The Governor shall designate the initial terms of the members of the Council from the public sector as follows: two members shall be appointed for a term of one year, expiring June 30, 1998; one member shall be appointed for a term of two years, expiring June 30, 1999; and one member shall be appointed for a term of three years, expiring June 30, 2000. Thereafter, all successors shall be appointed for a term of three years and until such person's successor is appointed and qualified. The Governor shall designate the initial terms of the member of the Council from the private sector as follows: one member shall be appointed for a term of one year, expiring June 30, 1998; two members shall be appointed for a term of two years, expiring June 30, 1999; and two members shall be appointed for a term of three years, expiring June 30, 2000. Thereafter, all successors shall be appointed for a term of three years and until such person's successor is appointed and qualified. Council members serve at the pleasure of the Governor and vacancies shall be filled by appointment by the Governor in the same manner as the appointment to the sector position represented on the Council which becomes vacant. An appointment to fill a vacancy, other than by expiration of a term of office, shall be for the balance of the unexpired term. Council vacancies shall be filled in the same manner that the original appointments were made.

e. The Council chairperson shall be appointed by the Governor and serve in that capacity for a period not to exceed three years. The selection of chairperson shall alternate between public and private sector representatives beginning with a public sector representative.

These changes shall take effect immediately.
