EXECUTIVE ORDER NO. 97-12


WHEREAS, Julian Kelley, the Mayor of Pawley's Island, has been indicted by the Georgetown County Grand Jury on one count of Unlawful Use of the Telephone; and

WHEREAS, S.C. Code Ann. Section 8-1-100 (Cum. Supp. 1996) provides, in pertinent part, that "...any State or County officer who is indicted in any Court for any crime may, in the discretion of the Governor, be suspended by the Governor, who in event of suspension shall appoint another in his stead until he shall be acquitted. In case of conviction, the office shall be declared vacant by the Governor and the vacancy filled as provided by law; and

WHEREAS, Mr. Kelley is an Officer of the State or its political subdivisions.

NOW, THEREFORE, pursuant to the powers conferred upon me by the Constitution and Statutes of the State of South Carolina, I hereby order that Julian Kelley shall be suspended from office until such time as the charge of Unlawful Use of the Telephone referenced above has been resolved, at which time further appropriate action will be taken by the undersigned.
