Amend the bill, as and if amended, by deleting in its entirety Section 59-40-50(B)(9) and inserting:
/ (9) elect its board of
directors annually.
(i)
At least one-third of the board positions must be open for
election annually, allowing for staggered terms of no more than
three years. Board members may be reelected for consecutive
terms as allowed by the charter school bylaws. All
employees of the charter school and all parents or guardians of
students enrolled in the charter school are eligible to
participate in the election. Parents or guardians of a student
shall have one vote for each student enrolled in the charter
school. A person who has been convicted of a felony must not be
elected to a board of directors;
(ii)
Section 59-40-50(B)(9)(i) does not apply to a charter
school that originated by application of a local school
district. In the case of a charter school that originated by
application of a local school district, the governing board of
the charter school consists of the elected members of the board
of trustees of the local school district; /
