EXPLANATION: Add new proviso in SDE for State of Emergency
Amend the bill, as and if amended, Part IB, Section 1A,
DEPARTMENT OF EDUCATION - EIA, page 326, after line 3, by adding
an appropriately numbered paragraph to read:
/ (SDE-EIA: State of Emergency) When
the State Superintendent of Education declares a state of
emergency in a school district that is the sponsor of a charter
school, and grounds exist to revoke the charter under Section
59-40-110(C) of the 1976 Code, the State Superintendent shall
have the authority to commence proceedings to revoke the
charter, notwithstanding the provisions of Section 59-40-110 or
a related charter contract, so long as the notice of proposed
revocation is provided at least thirty days before the first day
of the next school year. The charter school retains its rights
to a hearing and appeal pursuant to Section 59-40-110 (H) and
(J).//
