AN ACT TO AMEND THE, CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-11-3021, SO AS TO ESTABLISH HOBCAW POINT IN CHARLESTON COUNTY AS A BIRD AND GAME SANCTUARY AND PROVIDE FOR LIMITED TAKING OF GAME WITHIN THE SANCTUARY AREA UPON A FINDING BY THE DEPARTMENT OF WILDLIFE AND MARINE RESOURCES THAT SPECIFIED GAME CONSTITUTE A NUISANCE WITHIN THE AREA.

Be it enacted by the General Assembly of the State of South Carolina:

Bird and game sanctuary created

SECTION 1. Chapter 11 of Title 50 of the 1976 Code is amended by adding:

"Section 50-11-3021. There is hereby created a bird and game sanctuary in Charleston County which shall consist of the following area:

All that area in Charleston County in the City of Mt. Pleasant known and designated as the Hobcaw Point Subdivision.

It shall be unlawful to kill or maim any bird or animal or to use shotguns, rifles or pellet guns within the sanctuary.

Any person violating the provisions of this section shall be deemed guilty of a misdemeanor and upon conviction shall be fined not more than one hundred dollars or be imprisoned for not more any days.

On request of the governing body having jurisdiction over the Wildlife and Marine Resources shall conduct a study to determine whether or not wildlife within the sanctuary constitutes a nuisance or a threat to human health and welfare.

If it is, determined that the wildlife does constitute such a nuisance or threat the Executive Director may authorize the taking of wildlife within the sanctuary and prescribe the species of animal, the number of animals which may be taken and the method by which they may be taken. The taking of any animal under this section shall be accomplished under the supervision of a commissioned representative of the department."

Time effective

SECTION 2. This act shall take effect upon approval by the Governor.
