AN ACT TO AMEND SECTION 41-35-120, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO DISQUALIFYING CONDITIONS APPLICABLE TO STATE EMPLOYMENT SECURITY BENEFITS, SO AS TO PROVIDE FOR BENEFIT INELIGIBILITY IN CERTAIN CASES WHERE REMUNERATION IS RECEIVED BY AN EMPLOYEE UPON SEPARATION.

Be it enacted by the General Assembly of the State of South Carolina:

Benefit ineligibility

Section 1. Section 41-35-120 of the 1976 Code, as last amended by Act 609 of 1976, is further amended by adding the following new item:

"(7) Separation wages--For any week with respect to which he is receiving, has received, or will receive as a result of his separation from employment, remuneration in the form of (i) wages in lieu of notice, (ii) terminal leave pay, (iii) severance pay, (iv) separation pay, or (v) dismissal payments or wages by whatever name, regardless of whether the remuneration is voluntary or required. Provided, however, if such remuneration is less than the benefits which would otherwise be due he shall be entitled to receive for such week, if otherwise eligible, benefits reduced by the amount of such remuneration. If the case of lump sum payments, such payments shall be prorated by weeks on the basis of the most recent weekly wage of the individual."

Time effective

Section 2. This act shall take effect upon the approval by the Governor.
