AN ACT TO AMEND SECTION 20-7-410, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO CONCURRENT JURISDICTION OF MAGISTRATE COURTS, MUNICIPAL COURTS, AND CIRCUIT COURTS WITH FAMILY COURTS, SO AS TO PROVIDE THAT SUCH COURTS SHALL HAVE CONCURRENT JURISDICTION FOR THE TRIAL OF PERSONS UNDER SEVENTEEN YEARS OF AGE CHARGED WITH VIOLATIONS OF PROVISIONS OR TITLE 50 (FISH, GAME AND WATERCRAFT STATUTES), AND TO REQUIRE THE REPORTING OF CONVICTIONS TO THE WILDLIFE AND MARINE RE SOURCES DEPARTMENT.

Be it enacted by the General Assembly of the State of South Carolina:

Concurrent jurisdiction of courts

Section 1. Section 20-7-410, added to the 1976 Code by Act 71 of 1981, is amended by adding after "violations" on line six "or violations of the provisions of Title 50 relating to fish, game and watercraft", and by adding before the period in the last paragraph "and convictions of the provisions of Title 50 to the Wildlife and Marine Resources Department". The section when amended shall read:

"Section 20-7-410. Notwithstanding any other provisions of this article, the magistrate courts, municipal courts, and circuit courts of this State shall have concurrent jurisdiction with the family courts for the trial of persons under seventeen years of age charged with traffic violations or violations of the provisions of Title 50 relating to fish, game and watercraft when such courts would have jurisdiction of the offense charged if committed by an adult. The family court shall report all convictions of juveniles for moving traffic violations to the Department of Highways and Public Transportation as required by other courts of this State pursuant to Section 56-1-330 and convictions of the provisions of Title 50 to the Wildlife and Marine Resources Department."

Time effective

Section 2. This act shall take effect upon the approval by the Governor.
