A JOINT RESOLUTION APPROVING, RATIFYING AND JOINING IN THE CONVEYANCE OF SEVEN HUNDRED EIGHTY AND SEVEN-TENTHS ACRES OF REAL PROPERTY IN FAIRFIELD COUNTY, FORMERLY OWNED BY NEW HORIZONS DEVELOPMENT AUTHORITY, BY THE SOUTH CAROLINA STATE BUDGET AND CONTROL BOARD AND THE SOUTH CAROLINA DEPARTMENT OF PARKS, RECREATION AND TOURISM, AS GRANTORS, TO CRESCENT LAND AND TIMBER CORPORATION, AS GRANTEE.

Whereas, by Act 1076 of 1974 the New Horizons Development Authority was created; and

Whereas, the New Horizons Development Authority was to be dissolved five years from its date of inception, which would have been the year 1979; and

Whereas, by action of the Board of Directors of the New Horizons Development Authority, the assets, liabilities, powers, duties, and responsibilities were transferred to the South Carolina Department of Parks, Recreation and Tourism on June 30, 1978; and

Whereas, subsequent to June 30, 1978, the South Carolina Department of Parks, Recreation and Tourism exercised control over all of the real property even though there was never a deed from New Horizons Development Authority to the South Carolina Department of Parks, Recreation and Tourism conveying the real estate of record to the South Carolina Department of Parks, Recreation and Tourism; and

Whereas, by action of the South Carolina State Budget and Control Board on November 11, 1981, the South Carolina Department of Parks, Recreation and Tourism was authorized to enter into a land swap and purchase money arrangement with Crescent Land and Timber Corporation regarding seven hundred eighty and seventenths acres of real property formerly titled in the name of New Horizons Development Authority; and

Whereas, the South Carolina State Budget and Control Board under Section 11-9-630 of the 1976 Code has the authority to convey any and all lands owned by the State which are not in actual public use and not held in trust for a specific purpose and on December 11, 1981, did join with the South Carolina Department of Parks, Recreation and Tourism in executing and delivering a good and sufficient deed conveying the seven hundred eighty and seventenths acres vested in the name of the now defunct New Horizons Development Authority unto Crescent Land and Timber Corporation; and

Whereas, in order to clear any cloud on the title to the subject real estate regarding the authority of agencies of the State to make the subject conveyance, the South Carolina State Budget and Control Board and the South Carolina Department of Parks, Recreation and Tourism have covenanted to obtain approval and ratification by the South Carolina General Assembly of the subject conveyance. Now, therefore,

Be it enacted by the General Assembly of the State of South Carolina:

Transfer of real estate ratified

Section 1. The transfer of that seven hundred eighty and seventenths acres of real estate, formerly owned by New Horizons Development Authority, by the South Carolina State Budget and Control Board and the South Carolina Department of Parks, Recreation and Tourism (the grantors) to Crescent Land and Timber Corporation (the grantee), as is set forth in the deed of the grantors to the grantee dated December 11, 1981, recorded for record with the clerk of court for Fairfield County, South Carolina, on December 18, 1981, in Deed Book "GX" at page 292, is joined in, approved and ratified in all particulars, including the amount and type of consideration therefor.

Time effective

Section 2. This act shall take effect upon the approval by the Governor.
