AN ACT TO AMEND SECTION 24-27-30, CODE OF LAWS OF SOUTH CAROLINA, 1976, AND ACT 142 OF 1983 RELATING TO THE SOUTH CAROLINA SENTENCING GUIDELINES COMMISSION, SO AS TO DELAY CERTAIN DATES BY WHICH THE COMMISSION IS REQUIRED TO PRESCRIBE CERTAIN ADVISORY SENTENCING GUIDELINES.

Whereas, Act 142 of 1983 which took effect on June 15, 1983, in part requires the South Carolina Sentencing Guidelines Commission to prescribe, on or before December 31, 1983, advisory sentencing guidelines for the general sessions courts for all offenses for which a term of imprisonment of greater than one year is allowed; and

Whereas, the commission has been working diligently since its establishment to meet this timetable but still needs more time to adequately complete this assignment. Now, therefore,

Be it enacted by the General Assembly of the State of South Carolina:

Advisory sentencing guidelines

SECTION 1. Item (1) of Section 24-27-30 of the 1976 Code, which was added by the provisions of Act 142 of 1983, is further amended to read:

"(1) The commission shall prescribe, on or before December 31, 1984, advisory sentencing guidelines for the general sessions courts for all offenses for which a term of imprisonment of greater than one year is allowed."

Advisory sentencing guidelines delayed

SECTION 2. Section 3 of Act 142 of 1983 is amended to read:

"Section 3. The classification system which the commission is required to recommend to the General Assembly must be recommended on or before December 31, 1984."

Time effective

SECTION 3. This act shall take effect upon approval by the Governor.
