AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-3-75 SO AS TO PROVIDE THAT ANY PERSON WHO MALICIOUSLY TAMPERS WITH ANY HUMAN DRUG PRODUCT OR FOOD ITEM WITH THE INTENT TO DO BODILY HARM TO A PERSON IS GUILTY OF A FELONY; AND TO AMEND SECTION 16-1-10, AS AMENDED, RELATING TO THE CRIMES CLASSIFIED AS A FELONY, SO AS TO INCLUDE THE CRIME OF MALICIOUSLY TAMPERING WITH A HUMAN DRUG PRODUCT OR FOOD ITEM.
Be it enacted by the General Assembly of the State of South Carolina:
Penalty
SECTION 1. The 1976 Code is amended by adding:
"Section 16-3-75. Any person who unlawfully and maliciously tampers with any human drug product or food item with the intent to do bodily harm to a person is guilty of a felony and must be punished by imprisonment for not less than ten nor more than thirty years. When a person is found guilty, the jury may find a special verdict recommending mercy of the court and the punishment must be reduced to imprisonment for a term of not less than five years."
Crime declared felony
SECTION 2. In addition to the crimes classified as felonies in Section 16-1-10 of the 1976 Code, as last amended by Act 133 of 1983, the crime in Section 16-3-75, relating to tampering with human drug products or food items, is declared a felony.
Time effective
SECTION 3. This act shall take effect upon approval by the Governor.
