AN ACT TO AMEND SECTION 50-11-70, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO FIELD TRIALS, SO AS TO PROVIDE THAT THE SOUTH CAROLINA WILDLIFE AND MARINE RESOURCES DEPARTMENT SHALL PROMULGATE REGULATIONS TO PERMIT AND REGULATE FIELD TRIALS, TO PROVIDE FOR FIELD TRIALS FOR THE PURSUIT OF FURBEARERS DURING THE CLOSED SEASON, AND TO TRAIN RABBIT DOGS DURING THE CLOSED SEASON UNTIL SUCH TIME AS THE REGULATIONS ARE PROMULGATED, AND TO REPEAL SECTION 50-11-80 RELATING TO THE TAKING OF GAME IN FIELD TRIALS.
Be it enacted by the General Assembly of the State of South Carolina:
Department to promulgate regulations
SECTION 1. Section 50-11-70 of the 1976 Code is amended to read:
"Section 50-11-70. The Wildlife and Marine Resources Department (department) shall promulgate regulations to permit and regulate field trials at any time during the year including the closed season."
Department may issue field trial permits
SECTION 2. Until regulations are promulgated as required by Section 1 of this act, the department may issue field trial permits for the pursuit of furbearers during the closed season, when the field trials are sanctioned by a nationally recognized field trial organization. The applications for the permits must be sent to the Wildlife and Freshwater Fisheries Division of the department at least ten days prior to the trial. Each application shall include the name of the hunt club, the date of the trial, and the area involved in the trial.
The department may permit rabbit field trials during the closed season until regulations are promulgated as provided in Section 1 of this act if they are held within permanently maintained enclosures or outside of permanently maintained enclosures if the director considers that the trials do not endanger the local rabbit population.
Repeal
SECTION 3. Section 50-11-80 of the 1976 Code is repealed.
Time effective
SECTION 4. This act shall take effect upon approval by the Governor.
