AN ACT TO AMEND ACT 389 OF 1955, AS AMENDED, RELATING TO THE PIEDMONT SEWER, LIGHT AND FIRE DISTRICT OF ANDERSON AND GREENVILLE COUNTIES, SO AS TO AUTHORIZE THE DISTRICT TO ESTABLISH AND OPERATE A SYSTEM OF POLICE PROTECTION WITHIN THE DISTRICT UPON THE APPROVAL OF THE QUALIFIED ELECTORS IN A REFERENDUM.

Be it enacted by the General Assembly of the State of South Carolina:

District authorized to establish and operate police protection

SECTION 1. Section 3 of Act 389 of 1955, as last amended by Act 53 of 1983, is further amended by adding the following new item appropriately numbered which shall read:

"( ) Upon the approval of the qualified electors of the district in a referendum to be conducted at the same time as the 1986 general election, to establish and operate a system of police protection within the district and to employ a police officer for the district who will be known as the district public safety

officer. The governing commission of the district shall prescribe the public safety officer's duties and shall cause this officer to be trained in police work and also cross-trained in fire service work. In the district's fiscal year when the provisions of this item are first implemented, all funding therefor must come from available or surplus funds of the district or from grants, donations or other similar sources.

The commissioners of election for Greenville and Anderson Counties shall conduct and supervise the referendum in the manner governed by the election laws of this State mutatis mutandi. The commissioners shall have printed a sufficient number of ballots which have the following words thereon:

'Do you favor granting to the governing commission of the Piedmont Sewer, Light and Fire District the authority to establish a system of police protection for the district through the employment of a public safety officer the cost of which system during the first fiscal year of implementation must be paid from available or surplus funds of the district or from grants, donations or other similar sources?

Those voting in favor of the question shall deposit a ballot with a check or cross mark in the square after the words "Yes" and those voting against the question shall deposit a ballot with a check or cross mark in the square after the word "No".'

The commissioners of election shall appoint managers for the voting precincts and do all things necessary to carry out the referendum, including the counting of ballots and declaring the results thereof. The commissioners shall advertise the date of the referendum sixty days preceding it in a newspaper of general circulation in the district and shall publish a second notice thirty days before the referendum. The costs of the election must be borne by the district."

Time effective

SECTION 2. This act shall take effect upon approval by the Governor.
