AN ACT TO AMEND SECTION 20-3-60, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO VENUE FOR ACTIONS FOR DIVORCE FROM THE BONDS OF MATRIMONY, SO AS TO MAKE THE VENUE FOR ACTIONS FOR SEPARATE SUPPORT AND MAINTENANCE THE SAME AS FOR AN ACTION FOR DIVORCE.
Be it enacted by the General Assembly of the State of South Carolina:
Actions for divorce
SECTION 1. Section 20-3-60 of the 1976 Code is amended to read:
"Section 20-3-60. Actions for divorce from the bonds of matrimony or for separate support and maintenance must be tried in the county (a) in which the defendant resides at the time of the commencement of the action, (b) in which the plaintiff resides if the defendant is a nonresident or after due diligence cannot be found, or (c) in which the parties last resided together as husband and wife unless the plaintiff is a nonresident, in which case it must be brought in the county in which the defendant resides."
Time effective
SECTION 2. This act shall take effect upon approval by the Governor.
