AN ACT TO AMEND SECTION 42-1-80, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE DEFINITION OF THE TERM "COMMISSION" UNDER THE SOUTH CAROLINA WORKERS' COMPENSATION LAW, SO AS TO CHANGE THE NAME OF THE COMMISSION FROM THE SOUTH CAROLINA INDUSTRIAL COMMISSION TO THE SOUTH CAROLINA WORKERS' COMPENSATION COMMISSION; TO AMEND SECTION 42-3-10, RELATING TO THE CREATION AND THE DEPARTMENTS OF THE INDUSTRIAL COMMISSION, SO AS TO REFER THEREIN TO THE WORKERS' COMPENSATION COMMISSION IN ACCORDANCE WITH THE NAME CHANGE; TO PROVIDE THAT ANY OTHER REFERENCE IN THE 1976 CODE OR OTHER STATUTES TO THE "SOUTH CAROLINA INDUSTRIAL COMMISSION" OR "INDUSTRIAL COMMISSION" IS CHANGED TO THE "SOUTH CAROLINA WORKERS' COMPENSATION COMMISSION"; AND TO PROVIDE THAT STATE AGENCIES AND DEPARTMENTS AND POLITICAL SUBDIVISIONS OF THE STATE SHALL EXHAUST THE USE OF ALL CURRENT FORMS, STATIONERY, AND OTHER PRINTED MATERIAL BEFORE USING, PRINTING, OR PREPARING ANY NEW FORMS, STATIONERY, OR PRINTED MATERIAL REFLECTING THE CHANGE MADE IN THIS ACT.

Whereas, the South Carolina Industrial Commission administers the provisions of law relating to workers' compensation; and

Whereas, a change in the Commission's name to reflect more clearly and specifically what it does would benefit workers who need to contact the Commission and would eliminate any confusion existing with respect to which state agency deals with administering the laws on workers' compensation. Now, therefore,

Be it enacted by the General Assembly of the State of South Carolina:

Definition

SECTION 1. Section 42-1-80 of the 1976 Code is amended to read:

"Section 42-1-80. The term 'Commission' means the South Carolina Workers' Compensation Commission created under the provisions of this title."

Workers' Compensation Commission

SECTION 2. Section 42-3-10 of the 1976 Code is amended to read:

"Section 42-3-10. There is created the South Carolina Workers' Compensation Commission, hereinafter referred to as the Commission, composed of a judicial and administrative department and constituted and administered as provided for in this title."

References

SECTION 3. Other than as provided in Sections 1 and 2 of this act, wherever any reference is made in the 1976 Code or other statutes to the "South Carolina Industrial Commission" or "Industrial Commission", it is changed to the "South Carolina Workers' Compensation Commission". However, all state agencies and departments and all political subdivisions of the State shall exhaust the use of all current forms, stationery, and any other printed material before using, printing, or preparing any new forms, stationery, or printed material reflecting the change effected by this act.

Time effective

SECTION 4. This act shall take effect upon approval by the Governor.
