AN ACT TO AMEND SECTION 16-17-700, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO UNLAWFUL TATTOOING, SO AS TO PROVIDE THAT IT IS NOT UNLAWFUL FOR A LICENSED PHYSICIAN OR SURGEON TO TATTOO PART OF A PATIENT'S BODY IF IN HIS MEDICAL OPINION IT IS NECESSARY WHEN PERFORMING COSMETIC OR RECONSTRUCTIVE SURGERY.

Be it enacted by the General Assembly of the State of South Carolina:

Penalty

SECTION 1. Section 16-17-700 of the 1976 Code is amended to read:

"Section 16-17-700. It is unlawful for any person to tattoo any part of the body of another person; provided, that it is not unlawful for a licensed physician or surgeon to tattoo part of a patient's body if in his medical opinion it is necessary when performing cosmetic or reconstructive surgery. Any person violating the provisions of this section is guilty of a misdemeanor and, on conviction, must be punished by fine or imprisonment, or both in the discretion of the court."

Time effective

SECTION 2. This act shall take effect upon approval by the Governor.
