A BILL

TO AMEND SECTION 38-71-140, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO HEALTH INSURANCE COVERAGE FOR NEWLY BORN CHILDREN, SO AS TO REQUIRE COVERAGE ON THE CHILD FROM THE MOMENT OF BIRTH AND DELETE THE REFERENCES TO FAMILY MEMBER.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 38-71-140(A) of the 1976 Code, as last amended by Act 417 of 1990, is further amended to read:

"(A) All individual and group health insurance policies providing coverage on an expense-incurred basis and individual and group service or indemnity-type contracts issued by a nonprofit corporation which must provide coverage for a family member of the insured or subscriber, as to the family member's coverage, also must provide that the health insurance benefits applicable for children are payable with respect to a newly born child of the insured or subscriber from the moment of birth."

SECTION 2. This act takes effect upon approval by the Governor.
