A BILL

TO AMEND SECTION 9-1-1180, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE COMPENSATION OF TEACHERS AND OTHER SCHOOL EMPLOYEES WHICH IS CONSIDERED EARNABLE COMPENSATION FOR THE PURPOSES OF MAKING CONTRIBUTIONS TO THE STATE RETIREMENT SYSTEM AND THE REQUIRED CONTRIBUTIONS AND DEDUCTIONS THEREON, SO AS TO PROVIDE THAT INCENTIVE PAY OF TEACHERS, PRINCIPALS, AND OTHER ELIGIBLE STAFF IS PART OF THEIR BASE SALARY FOR PURPOSES OF COMPUTING THEIR RETIREMENT BENEFITS, AND TO PROVIDE FOR THE MANNER IN WHICH EMPLOYEE AND EMPLOYER CONTRIBUTIONS ON THIS INCENTIVE PAY MUST BE MADE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 9-1-1180 of the 1976 Code is amended to read:

"Section 9-1-1180. (A) The deductions authorized hereunder by this chapter from the earnable compensation of teachers, the payments by employers of teachers of the required percentages of earnable compensation and all retirement allowances or other benefits herein provided in this chapter, shall must be calculated upon the full earnable compensation of teachers from public funds derived from any source, and all employers' contributions for teachers shall must be paid by the State. Provided, further, that all All employers' contributions for employees of the various county technical training schools shall must also be paid by the State, effective July 1, 1962.

(B) Payments for unused sick leave, single special payments at retirement, bonus and incentive-type payments except as otherwise provided in subsection (C), or any other payments not considered a part of the regular salary base are not compensation for which contributions are deductible. Contributions are deductible on pay for unused annual leave.

(C) Incentive pay of teachers, principals, and other eligible staff awarded pursuant to Article 10, Chapter 21 of Title 59 and any other incentive compensation awarded such persons under other provisions of law are part of those persons' regular base salary for purposes of computing their retirement benefits under this chapter. For incentive pay awarded before or after the effective date of this subsection, such persons must pay the employer and employee contributions required on this incentive pay in the manner determined by the board."

SECTION 2. This act takes effect upon approval by the Governor.
