TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 6-11-315 SO AS TO CLARIFY THAT SPECIAL PURPOSE DISTRICTS IN EXISTENCE BEFORE MARCH 7, 1973, MAY HIRE AND DISMISS AND SET THE COMPENSATION OF DISTRICT PERSONNEL, TO PROVIDE THAT PROPERTY OF A SPECIAL PURPOSE DISTRICT PURCHASED WITH DISTRICT FUNDS, HOWEVER PROCURED, IS PROPERTY OF THE DISTRICT, TO PROVIDE THAT SPECIAL PURPOSE DISTRICTS ESTABLISHED BY REFERENDUM BEFORE MARCH 7, 1973, MAY NOT BE REDUCED OR DIMINISHED BY THE COUNTY COUNCIL EXCEPT UPON APPROVAL OF A MAJORITY OF THE DISTRICT'S QUALIFIED ELECTORS IN A REFERENDUM, AND TO PROVIDE THAT A SPECIAL PURPOSE DISTRICT MILLAGE INCREASE APPROVED BY A COUNTY COUNCIL MAY NOT BE DECREASED EXCEPT WITH THE APPROVAL OF THE GOVERNING BODY OF THE DISTRICT AND TO PROVIDE AN EXCEPTION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 1, Chapter 11, Title 6 of the 1976 Code is amended by adding:
"Section 6-11-315. (A) In addition to the powers granted a special purpose district pursuant to Section 6-11-100, a special purpose district in existence before March 7, 1973, may employ and terminate personnel and set the compensation of district personnel.
(B) Real and personal property purchased by a special purpose district from district revenues, regardless of the procurement method, is the property of the purchasing district.
(C) Notwithstanding the provisions of Section 6-11-420, the governing body of a county may not reduce or diminish a special purpose district created by referendum before March 7, 1973, without the approval of a majority of the qualified electors of the special purpose district in a subsequent referendum.
(D) If the millage imposed for a special purpose district is increased pursuant to Section 6-11-275, the millage rate may not thereafter be reduced without the approval of the governing body of the special purpose district except for uniformly applied millage decreases attributable to equalization and reassessment in the county."
SECTION 2. This act takes effect upon approval by the Governor.
