TO AMEND SECTION 11-35-3230, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PROFESSIONAL ARCHITECTURAL-ENGINEERING OR LAND SURVEYING CONTRACTS, SO AS TO CLARIFY THE PROVISIONS GOVERNING THE NEGOTIATION AND AWARD OF SMALL CONTRACTS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 11-35-3230(2) of the 1976 Code is amended to read:
"(2) Maximum Fees Payable to One Person or Firm. Fees paid pursuant to this section during the twenty-four month period immediately preceding negotiation of the small contract by any single governmental body for professional services performed by any one architectural-engineering or land surveying firm pursuant to this section and Section 11-35-3220 shall must not exceed an amount to be established by regulation of the board. All persons A person or firms seeking firm negotiating to render provide professional services pursuant to this section shall must furnish the governmental body with whom the firm is negotiating a list of the professional services, including the fees paid therefor, performed for and fees charged to the governmental body during the current and the two preceding fiscal year years. immediately preceding the fiscal year in which the negotiations are occuring and during the fiscal year in which the negotiations are occurring."
SECTION 2. This act takes effect upon approval by the Governor.
