A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING A NEW SECTION TO TITLE 9 SO AS TO ALLOW A RETIRED STATE EMPLOYEE TO DRAW RETIREMENT COMPENSATION WHILE EMPLOYED BY A PUBLIC INSTITUTION OF EDUCATION AND TO PROVIDE CERTAIN EXCEPTIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Title 9 of the 1976 Code is amended by adding an appropriately numbered section to read:

"Notwithstanding any other provision of law, a retired state employee may draw retirement compensation while employed by a public institution of education; provided, however, that such employee while so employed may not contribute to, or receive credit in, the South Carolina Retirement System for teachers and employees of the State and political subdivisions or agencies or departments thereof."

SECTION 2. This act takes effect upon approval by the Governor.
