AN ACT TO AMEND SECTION 10-5-220, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO DEFINITIONS FOR PURPOSES OF THE BARRIER FREE DESIGN STANDARDS LAW, SO AS TO DELETE THE REQUIREMENT IN THE DEFINITION OF "RENOVATION" THAT THE CHANGES IN THE PROJECT MUST BE STRUCTURAL TO COME WITHIN THE DEFINITION AND TO AMEND SECTION 10-5-273, AS AMENDED, RELATING TO THE EXCEPTION PROVIDED FOR UPPER FLOORS UNDER THESE STANDARDS FOR BUILDINGS OF A CERTAIN SIZE, SO AS TO REVISE THIS EXCEPTION.

Be it enacted by the General Assembly of the State of South Carolina:

Renovation defined

SECTION 1. Section 10-5-220(5) of the 1976 Code is amended to read:

"(5) `Renovation' means a construction project where at least thirty-five percent of the building or facility is changed."

Standards to apply

SECTION 2. Section 10-5-273 of the 1976 Code, as amended by Act 400 of 1990, is further amended to read:

"Section 10-5-273. The standards established pursuant to this article do not apply to the floors above grade of any building where such building does not exceed five thousand square feet in area for each floor, does provide accessibility at grade floor levels, and does not provide elevator service."

Time effective

SECTION 3. This act takes effect July 1, 1991.
