TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-13-225 SO AS TO PROHIBIT A PERSON FROM USING OR AUTHORIZING THE USE OF PUBLIC FUNDS, EMPLOYEES, MATERIAL, EQUIPMENT, SERVICES, OR ANY OTHER PUBLIC PROPERTY VALUED AT MORE THAN TWO HUNDRED DOLLARS FOR PRIVATE USE OR BENEFIT OTHER THAN IN THE LAWFUL PERFORMANCE OF OFFICIAL DUTIES, AND TO PROVIDE PENALTIES FOR VIOLATION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 13, Title 16 of the 1976 Code is amended by adding:
"Section 16-13-225. (A) For the purpose of this section, `public body' means a department of the State, a state board, commission, committee, agency, and authority, a public or governmental body or political subdivision of the State, including counties, municipalities, school districts, and special purpose or public service districts, or an organization, corporation, or agency supported in whole or in part by public funds or expending public funds and includes a quasi-governmental body of the State and its political subdivisions, including, but not limited to, the South Carolina Public Service Authority and the South Carolina State Ports Authority.
(B) It is unlawful for a person, other than in the lawful performance of official duties, to use or authorize the use of public body funds, services of public body employees, material, equipment, services, or other public body property valued at more than two hundred dollars for private use or benefit.
(C) A person violating the provisions of this section is guilty of a misdemeanor and, upon conviction, must be fined not more than five thousand dollars or imprisoned for not more than five years, or both.
(D) The provisions of this section do not affect the applicability of any other provision of law relating to the unlawful or fraudulent use of public property."
SECTION 2. This act takes effect upon approval by the Governor.
