A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 20-7-495 SO AS TO PROVIDE FOR THE AUDIOTAPING OF INTERVIEWS CONDUCTED OF A SUSPECTED ABUSED OR NEGLECTED CHILD AND FOR THE TAPE'S PRESERVATION AND CONFIDENTIALITY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Subarticle 1, Article 7, Chapter 7, Title 20 of the 1976 Code is amended by adding:

"Section 20-7-495. Any initial interview conducted of a child pursuant to this article or any criminal proceeding to determine whether he has been abused or neglected must be audiotaped, and the tape must be preserved as a record in the case if there is probable cause for the case. The tape is subject to the same confidentiality requirements as any other record in the case as provided in Sections 20-7-690 and 20-7-780."

SECTION 2. This act takes effect upon approval by the Governor.
