A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 57-11-100 SO AS TO ESTABLISH THE LEGISLATIVE DISCRETIONARY ACCOUNT WITHIN THE STATE HIGHWAYS AND PUBLIC TRANSPORTATION FUND, TO PROVIDE FOR ITS FUNDING, AND TO PROVIDE THE MANNER AND AMOUNT IN WHICH ACCOUNT PROCEEDS MAY BE EXPENDED.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Article 1, Chapter 11, Title 57 of the 1976 Code is amended by adding:

"Section 57-11-100. There is established within the State Highways and Public Transportation Fund a separate Legislative Discretionary Account to which must be credited four million, two hundred fifty thousand dollars annually by reducing proportionately those accounts to which gasoline and other motor fuels tax revenues are credited. Expenditures from this account must be made by the department on the warrant of individual members of the General Assembly and used as the members direct for those purposes for which revenues of the State Highways and Public Transportation Fund may be expended lawfully. No individual member of the General Assembly may authorize expenditures in excess of twenty-five thousand dollars annually."

SECTION 2. This act takes effect July 1, 1991.
