A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-13-238 SO AS TO AUTHORIZE THE WILDLIFE AND MARINE RESOURCES DEPARTMENT TO SET AND PUBLISH THE DAILY CREEL AND SIZE LIMITS FOR STRIPED BASS, HYBRIDS STRIPED BASS, AND BLACK BASS; TO AMEND SECTION 50-13-210, AS AMENDED, RELATING TO THE DAILY CREEL LIMITS ON GAME FISH, SO AS TO DELETE THE REFERENCE TO THE AUTHORITY FOR DEPARTMENT REGULATIONS; TO AMEND SECTION 50-13-285, RELATING TO PENALTIES FOR EXCEEDING CREEL LIMITS, SO AS TO REVISE THE CONVICTIONS TO WHICH THE PENALTIES APPLY; TO AMEND SECTION 50-13-1760, RELATING TO WHITE PERCH, SO AS TO CHANGE THE TIME FOR SALE OF THE FISH; AND TO REPEAL SECTIONS 50-13-220 AND 50-13-230 RELATING TO STRIPED BASS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 50-13-238. The department may set the daily creel limits and size limits for striped bass (rockfish), hybrids striped bass (striped bass and white bass), and black bass (largemouth). The department shall publish the limits by July first each year in the State Register and in at least one newspaper having general circulation in each county of the State. A person taking striped bass, hybrids striped bass, or black bass exceeding the limits set by the department is guilty of a misdemeanor and, upon conviction, must be punished as provided in Section 50-13-285."

SECTION 2. Section 50-13-210 of the 1976 Code, as last amended by Act 192 of 1989, is further amended to read:

"Section 50-13-210. It is unlawful for a person in any one day to catch more than forty game fish; however. However, of the total creel limit not more than:

(1) not more than ten of the total may be striped bass, (Rockfish), or hybrid bass, (striped bass-white bass), or a combination of them unless regulations promulgated by the department and adopted by the General Assembly by authority of Section 50-13-236 reflect otherwise;

(2) not more than ten of the total may be black bass (large mouth, small mouth, coosae) or a combination of them unless regulations promulgated by the department and adopted by the General Assembly by authority of Section 50-13-236 reflect otherwise;

(3) not more than ten of the total may be trout; (4) not more than eight of the total may be walleye or sauger or a combination of them;

(5) not more than thirty of the total may be any a game fish not specified."

SECTION 3. Section 50-13-285 of the 1976 Code is amended to read:

"Section 50-13-285. Any A person violating the provisions of Sections Section 50-13-210, 50-13-220, 50-13-238, 50-13-250, or 50-13-280 must, upon conviction for a first offense, of any of the sections must be fined not less than thirty dollars nor more than two hundred dollars or imprisoned for not more than thirty days and for a subsequent offense of any of the sections be fined not less than three hundred dollars nor more than five hundred dollars or imprisoned for not more than sixty days, or both. Subsequent A subsequent offense is an offense against any of the sections section and not any one in particular. But only those offenses of any of the sections An offense which occurred within a period of two years, including and immediately preceding the date of the last offense shall constitute constitutes a prior offenses offense within the meaning of this section."

SECTION 4. Section 50-13-1760 of the 1976 Code is amended to read:

"Section 50-13-1760. (A) It shall be is illegal to sell any white perch (Marone Americana) caught in this State. Only those fish imported into the State from another state may be sold, and an invoice showing the origin and the number or poundage shall must accompany the transporting vehicle and such. The invoice shall must be retained at the market or place of retail sale.

(B) Only fresh fish on ice with an invoice not over two weeks old shall may be sold lawfully sold. Frozen fish may must not be sold. White perch may be sold only during the period of January first through May thirty-first.

(C) If a shipment of fish or portion of a shipment is sold to another dealer within a state, a copy of the original invoice shall must accompany the fish during the transportation and at the market place. In addition a new bill of sale shall must accompany the fish showing them as a portion of the fish bought under the original sale from out-of-state with the original invoice number included.

(D) Any A person violating the provisions of this section shall be deemed is guilty of a misdemeanor and, upon conviction, shall must be fined not more than two hundred dollars or imprisoned for not more than thirty days."

SECTION 5. Sections 50-13-220 and 50-13-230 of the 1976 Code are repealed.

SECTION 6. This act takes effect July 1, 1991.
