TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 47-13-1375 SO AS TO PROVIDE THAT HORSES SOLD OR AUCTIONED MUST BE TESTED BY THE STATE VETERINARIAN OR AN ACCREDITED VETERINARIAN WHO SHALL ISSUE A CERTIFICATE THAT THE ANIMAL SOLD MEETS ALL EXISTING HEALTH REQUIREMENTS AND TO PROVIDE PAYMENT FOR THIS SERVICE; TO AMEND SECTION 47-13-1350, AS AMENDED, RELATING TO TESTING OF HORSES BEFORE ENTRY INTO SOUTH CAROLINA, SO AS TO REQUIRE A CERTIFICATE STATING THAT THE HORSE HAS NOT BEEN EXPOSED RECENTLY TO EQUINE INFECTIOUS ANEMIA, THAT THE ANIMAL'S TEMPERATURE IS NORMAL, AND THE ANIMAL IS FREE OF ANY CONTAGIOUS OR INFECTIOUS DISEASES; TO AMEND SECTION 47-13-1370, AS AMENDED, RELATING TO PROOF OF TESTS FOR PUBLIC ASSEMBLY OF HORSES, SO AS TO REQUIRE THAT HORSES NEED ONLY TEST NEGATIVE FOR EQUINE INFECTIOUS ANEMIA WITHIN THE LAST TWELVE MONTHS INSTEAD OF SIX MONTHS AND TO CREATE AN EXCEPTION FOR HORSES TO BE SOLD OR AUCTIONED.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 13, Chapter 13, Title 47 of the 1976 Code is amended by adding:
"Section 47-13-1375. At all organized sales, including auctions of horses, the state veterinarian or an accredited veterinarian shall examine the animal and extract a blood sample to test for equine infectious anemia. The veterinarian shall issue to the purchaser of a horse sold a certificate that the animal meets all existing health requirements and that the temperature of the animal is normal. Results of the test must be reported pursuant to the provisions of this article.
The cost of this service must be paid by the seller and may not exceed seven dollars a head. The fee must be used to offset the cost of the test and record maintenance. The state veterinarian will collect the fee and be responsible for keeping the records."
SECTION 2. Section 47-13-1350 of the 1976 Code, as last amended by Act 375 of 1990, is further amended to read:
"Section 47-13-1350. It is unlawful to enter the State with any a horse unless the horse has been tested for equine infectious anemia and reacted negatively within six twelve months before entry and is accompanied by a certificate from an accredited veterinarian from the state of origin of the horse, certifying that the animal has not been exposed recently to a contagious or infectious disease, that the animal's temperature is normal, and that the animal is free of any contagious or infectious disease. The state veterinarian, with the advice of the commanding officer of the State Highway Patrol, shall promulgate regulations to provide for the enforcement of this section unless the horse is being transported to any organized sale."
SECTION 3. Section 47-13-1370 of the 1976 Code, as last amended by Act 375 of 1990, is further amended to read:
"Section 47-13-1370. (A) All horses must be accompanied by written proof of an approved negative test for equine infectious anemia or a certificate pursuant to Section 47-13-1350 when entering any public assembly of horses. These public assemblies include, but are not limited to, shows, fairs, organized trail rides, rodeos, and other exhibitions, as well as organized sales. Animals moving directly to a slaughter plant or assembly point for slaughter which has been specifically approved by the state veterinarian are not subject to the negative test requirement. The owner, operator, or person in charge of these shows, fairs, organized trail rides, rodeos, and other exhibitions, organized sales, and other public places where horses are assembled shall require that each animal be accompanied by an official certificate showing that it has been negative to an approved test for equine infectious anemia within the last six twelve months. Horses to be sold at organized sales or auctions must be examined and tested pursuant to Section 47-13-1375. (B) Horses which are permanently maintained at a public stable or other public facility must be tested for equine infectious anemia each twelve months."
SECTION 4. This act takes effect upon approval by the Governor.
