TO REQUIRE THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL TO PROVIDE FOR THE HOLDING OF A PUBLIC HEARING BEFORE A LANDFILL MAY BE ESTABLISHED IN ANY LOCALITY IN THIS STATE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Before a landfill of any nature may be established in any locality in this State, the Department of Health and Environmental Control shall provide for the holding of a public hearing in the locality where the landfill is sought to be established. The department shall give notice of the hearing in a newspaper of general circulation in the locality twenty-one days before the hearing is to be held and again seven days before the hearing is to be held. The newspaper notice shall specify the date, time, exact location, and the precise nature and purpose of the public hearing. Any person having an interest in establishing or preventing the establishment of the landfill in the locality must be allowed to speak at the hearing.
SECTION 2. This act takes effect upon approval by the Governor.
