TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 44-56-150 SO AS TO ESTABLISH THE ENVIRONMENTAL TRAINING FUND AND SECTION 48-1-355 SO AS TO PROVIDE THAT OF THE CIVIL PENALTIES COLLECTED PURSUANT TO SECTIONS 44-56-140 AND 48-1-330, THE FIRST TWO HUNDRED THOUSAND DOLLARS MUST BE USED TO FINANCE THE FUND AND TO PROVIDE A TEN THOUSAND DOLLAR CONTRIBUTION TO THE SOUTHEAST WASTE EXCHANGE FROM PENALTIES COLLECTED FROM THESE CIVIL PENALTIES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 1, Chapter 56, Title 44 of the 1976 Code is amended by adding:
"Section 44-56-150. (A) There is created within the State Treasury the Environmental Training Fund, separate and distinct from the general fund of the State, to ensure the availability of funds for the conduct of environmental training programs by the South Carolina Environmental Training Center. Of the civil penalties collected pursuant to Sections 44-56-140 and 48-1-330, the first two hundred thousand dollars must be remitted to the State Treasurer and credited to this fund. When the amount of monies paid into the fund pursuant to this section reaches an aggregate amount of two hundred thousand dollars, payments into the fund shall cease until the next fiscal year when funds collected are again credited to the fund until the fund reaches two hundred thousand dollars.
(B) The fund must be expended by the South Carolina Environmental Training Center solely for the purpose of conducting environmental training programs which include, but are not limited to, employee and management training related to compliance and technical issues in air, water quality, hazardous materials, and waste management.
(C) The State Treasurer shall disburse the funds to the State Board for Technical and Comprehensive Education which shall disburse the funds quarterly to the South Carolina Environmental Training Center. Interest that accrues from the management of the funds held pursuant to this section must be credited to this fund. Funding for these activities is in addition to, and not a substitute for, annual general appropriations by the General Assembly."
SECTION 2. Chapter 1, Title 48 of the 1976 Code is amended by adding:
"Section 48-1-355. (A) Of the civil penalties collected pursuant to Sections 48-1-330 and 44-56-140, the first two hundred thousand dollars must be remitted to the State Treasurer and credited to the Environmental Training Fund authorized pursuant to Section 44-56-150. When the amount of monies collected and paid into the fund reaches an aggregate of two hundred thousand dollars, payments into the fund shall cease until the next fiscal year when funds collected are again credited to the fund until the fund reaches two hundred thousand dollars.
(B) Of the civil penalties collected pursuant to Sections 48-1-330 and 44-56-140 in excess of two hundred thousand dollars, ten thousand dollars must be contributed annually to the Southeast Waste Exchange, a nonprofit organization based in Charlotte, North Carolina, serving both North and South Carolina. Payment must be made to the South Carolina Department of Health and Environmental Control for transfer to the Southeast Waste Exchange."
SECTION 3. This act takes effect upon approval by the Governor.
