TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 22-1-17 SO AS TO PROVIDE A PROCEDURE FOR SELECTING A CHIEF MAGISTRATE FOR ADMINISTRATIVE DUTIES FOR EACH COUNTY AND ONE OR MORE ASSOCIATE CHIEF MAGISTRATES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 1, Title 22 of the 1976 Code is amended by adding:
"Section 22-1-17. Each county shall have one chief magistrate for administrative duties which must be assigned by the Chief Justice of the South Carolina Supreme Court. The chief magistrate shall serve a term of six months commencing on January first and July first during each calendar year and must be elected by a simple majority vote of the magistrates serving in each county. Each magistrate in the county has one vote, whether the magistrate is designated as full-time, part-time, or ministerial, in choosing the chief magistrate for the county.
In addition to the chief magistrate, each county may have one or more associate chief magistrates to assist the chief magistrate in the performance of these duties. Associate chief magistrates must be elected in the same manner as the chief magistrate.
Upon election, the chief magistrate and any associate chief magistrate shall notify the Office of Court Administration of their election."
SECTION 2. This act takes effect upon approval by the Governor.
