A BILL

TO AMEND CHAPTER 17, TITLE 7, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE CANVASSING AND CERTIFICATION OF ELECTION RESULTS, BY ADDING ARTICLE 9 SO AS TO PROVIDE THAT NO GOVERNMENTAL OR POLITICAL BODY AUTHORIZED TO HEAR ELECTION PROTESTS OR APPEALS MAY UPHOLD A PROTEST IF THE TOTAL NUMBER OF CONTESTED VOTES IS INSUFFICIENT TO AFFECT THE RESULT OF THE ELECTION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Chapter 17, Title 7 of the 1976 Code is amended by adding:

"Article 9

Provisions Applicable to All

Election Protests and Appeals

Section 7-17-1010. No governmental or political body, including any court in this State, authorized by law to hear and decide election protest and appeals, may uphold a protest if the total of the contested votes is insufficient to affect the result of the election."

SECTION 2. This act takes effect upon approval by the Governor.
