A BILL

TO AMEND ARTICLE 5, CHAPTER 3 OF TITLE 1, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO APPOINTMENT AND REMOVAL OF OFFICERS, BY ADDING AN APPROPRIATELY NUMBERED SECTION, SO AS TO PROVIDE THAT ALL APPOINTMENTS MADE BY THE GOVERNOR, WITH THE ADVICE AND CONSENT OF THE SENATE, SHALL EXPIRE ON JANUARY THIRTIETH OF EACH YEAR FOLLOWING A GUBERNATORIAL ELECTION AND TO PROVIDE FOR THE REMOVAL OF SUCH OFFICERS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Article 5, Chapter 3 of Title 1 of the 1976 Code is amended by adding an appropriately numbered section to read:

"Section . (A) Beginning in 1995, all appointments made by the Governor with the advice and consent of the Senate as present in subsection (B) shall expire on January thirtieth of each year following a gubernatorial election. Thereafter, the Governor shall, with the advice and consent of the Senate, make such appointments as may be necessary. All persons appointed to such offices pursuant to this section shall be subject to removal by the Governor, at any time at his discretion, either with or without cause. Upon the expiration of an office holder's term, such individual may continue to serve until a successor has been appointed and qualifies. Nothing in this section shall be construed to alter, diminish, or expand the authority of the Governor to make appointments to the respective boards and commissions in subsection (B). Only the term of office of the various board and commission members are effected by the provisions of this section.

(B) Appointments to the following offices shall be subject to the provisions of subsection (A):

(1) Director of the State Worker's Compensation Fund as contained in Section 42-7-20.

(2) Permanent Advisory Committee of the State Development Board as contained in Section 13-3-130.

(3) South Carolina Commission on Alcohol and Drug Abuse as contained in Section 44-49-10.

(4) South Carolina State Development Board as contained in Section 13-3-40.

(5) South Carolina Worker's Compensation Commission as contained in Section 42-3-20. (1) Advisory Committee to the S.C. Sea Grant Consortium Director as contained in Section 48-45-80.

(6) Advisory Committee to the South Carolina Department of Insurance as contained in Section 38-3-90.

(7) Advisory Council to the Board for Continuum of Care for Emotionally Disturbed Children as contained in Section 20-7-5630.

(8) Atlantic States Marine Fisheries Commission as contained in Section 50-7-10.

(9) Board of Continuum of Care for Emotionally Disturbed Children as contained in Section 20-7-5620.

(10) Board of Directors of the Jobs-Economic Development Authority as contained in Section 41-43-40.
