TO AMEND SECTION 16-15-110 OF THE CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE PENALTIES FOR PROSTITUTION, SO AS TO ADD APPROPRIATELY NUMBERED SUBSECTIONS TO PROVIDE FOR THE FORFEITURE OF A VEHICLE OCCUPIED BY A PERSON AT THE TIME OF AND USED IN THE VIOLATION OF THE PROVISIONS OF SECTIONS 16-15-90 OR 16-15-100 WHICH PERTAIN TO PROSTITUTION AND THE UNLAWFUL ACTS ASSOCIATED THEREWITH.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 16-15-110 of the 1976 Code is amended by adding appropriately numbered subsections to read:
"( ) A vehicle, vessel, or aircraft, excluding common carriers, occupied by a person at the time of and used in the violation of the provisions of Sections 16-15-90 or 16-15-100 shall be subject to forfeiture and may be seized without process if the seizure is incident to arrest.
( ) When a violation of Sections 16-15-90 or
16-15-100 is committed by a person who is not the owner of the vehicle, vessel, or aircraft and such vehicle, vessel, or aircraft is seized pursuant to this section, the owner may redeem the vehicle, vessel, or aircraft pursuant to the provisions of Section 44-53-586, which shall be applied to seizure of property under this section.
The forfeiture procedures, disposition of forfeited property, and disposition of proceeds of sales shall be instituted within a reasonable time and be governed by Section 44-53-530, which shall be applied to forfeiture of property under this section. The law enforcement agency seizing the property shall take reasonable steps to maintain the property."
SECTION 2. If any clause, sentence, paragraph, subdivision, or part of this act or the application thereof to any person shall be adjudged by any court of competent jurisdiction to be invalid or unconstitutional, such judgment shall not affect, impair, or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this act or in its application to the person directly involved in the controversy in which such judgment shall be rendered.
SECTION 3. This act takes effect upon approval by the Governor.
