A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-15-379 SO AS TO PROHIBIT VIEWING OR POSSESSING OF ANY MATERIAL OR PERFORMANCE THAT SHOWS A MINOR ENGAGED IN SEXUAL ACTIVITY, SEXUALLY EXPLICIT NUDITY, OR OTHER CONDUCT HARMFUL TO MINORS, TO PROVIDE A DEFINITION, AND TO PROVIDE A PENALTY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 16-15-379. (A) It is unlawful for a person to possess or view any material or view a performance that shows a minor engaged in sexual conduct as defined in Section 16-15-305, sexual activity as defined in Section 16-15-375, sexually explicit nudity as defined in Section 16-15-375, or engaged in other conduct harmful to minors as defined in Section 16-15-375.

(B) A person who violates this section is guilty of a misdemeanor and, upon conviction, must be imprisoned not more than six months or fined not more than five hundred dollars, or both.

(C) For purposes of this section `minor' means a person under the age of eighteen."

SECTION 2. This act takes effect upon approval by the Governor.
