TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 15-3-547 SO AS TO EXEMPT FROM CIVIL LIABILITY LICENSED HEALTH CARE PROFESSIONALS FOR SERVICES PERFORMED AT FREE CLINICS AND TO PROVIDE EXCEPTIONS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 5, Chapter 3, Title 15 of the 1976 Code is amended by adding:
"Section 15-3-547. No licensed health care professional is liable for civil damages for an act or omission resulting from rendering a health care service at a clinic where no charges are made for a health care service furnished at the clinic unless the act or omission amounts to gross negligence or wilful or wanton misconduct. This section applies only to a person rendering services voluntarily and without compensation paid to him or to any other person, corporation, or other organization."
SECTION 2. This act takes effect upon approval by the Governor.
