TO AMEND SECTION 56-5-2950, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO CHEMICAL TESTS OF BREATH, BLOOD, AND URINE TO DETERMINE THE PRESENCE OF ALCOHOL OR DRUGS IN THE OPERATOR OF A MOTOR VEHICLE, SO AS TO PROVIDE THAT A PERSON OPERATING A MOTOR VEHICLE INVOLVED IN AN ACCIDENT RESULTING IN A DEATH MUST HAVE A TEST PROVIDED BY THIS SECTION ADMINISTERED TO DETERMINE THE PRESENCE OF ALCOHOL OR DRUGS IN HIM.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 56-5-2950 of the 1976 Code is amended by adding:
"(i) A person operating a motor vehicle involved in an accident resulting in the death of or serious bodily injury to himself or another person must have his breath, blood, or urine tested in a manner provided by this section to determine the presence of alcohol or drugs. The testing is mandatory and the person or his personal representative may not refuse to take a test or have a test administered. The results of any test administered pursuant to this section may be used as evidence in a criminal proceeding."
SECTION 2. This act takes effect upon approval by the Governor.
