A BILL

TO AMEND SECTION 8-1-145, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE IRREVOCABLE RESIGNATION OF AN ELECTED OFFICEHOLDER, SO AS TO PROVIDE THAT IF A PERSON RESIGNS HIS OFFICE BECAUSE HE IS OFFERING FOR ANOTHER POPULARLY ELECTED OFFICE, THE OFFICE IS NOT CONSIDERED VACATED UNTIL A SUCCESSOR IS ELECTED AND QUALIFIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 8-1-145 of the 1976 Code, as last amended by Act 382 of 1990, is further amended by adding:

"(D) If the person resigns his office under the provisions of this section because he is offering for another popularly elected office, the office is not considered vacated until a successor is elected and qualifies."

SECTION 2. This act takes effect upon approval by the Governor.
