TO AMEND SECTION 44-79-20, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO DEFINITIONS IN THE PHYSICAL FITNESS SERVICES ACT, SO AS TO REVISE THE DEFINITION OF "CENTER"; TO AMEND SECTION 44-79-30, AS AMENDED, RELATING TO PHYSICAL FITNESS SERVICES CREDIT CONTRACT REQUIREMENTS, SO AS TO DEFINE A CREDIT CONTRACT AS ONE LASTING OVER THREE MONTHS OR OVER ONE HUNDRED DOLLARS IN AMOUNT RATHER THAN FOR OVER ONE MONTH OR OVER FIFTY DOLLARS IN AMOUNT; AND TO REPEAL SECTION 44-79-110 RELATING TO EXEMPTIONS FROM THE PHYSICAL FITNESS SERVICES ACT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 44-79-20(5) of the 1976 Code is amended to read:
"(5) `Center' means any a person or organization which, for profit a fee, offers physical fitness services, whether at multiple outlets bearing the same name or a single outlet. Any A subsidiary of a center, operating under the same name and offering such services, is a part of the center."
SECTION 2. That portion of Section 44-79-30 before item (1) of the 1976 Code is amended to read:
"Every prepaid or credit contract for physical fitness services of over one month's three months' duration or over fifty one hundred dollars in amount must conform to the following requirements:".
SECTION 3. Section 44-79-110 of the 1976 Code is repealed.
SECTION 4. This act takes effect upon approval by the Governor.
