TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 15-3-546 SO AS TO EXEMPT FROM CIVIL LIABILITY LICENSED HEALTH CARE PROFESSIONALS FOR SERVICES PERFORMED AT FREE CLINICS AND TO PROVIDE EXCEPTIONS AND TO ALLOW ATTORNEY'S FEES TO THE PREVAILING HEALTH CARE PROFESSIONAL.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 5, Chapter 3, Title 15 of the 1976 Code is amended by adding:
"Section 15-3-546. No licensed health care professional is liable for civil damages for an act or omission resulting from rendering a health care service at a clinic where no charges are made for a health care service furnished at the clinic unless the act or omission amounts to gross negligence or wilful or wanton misconduct. This section applies only to a person rendering services voluntarily and without compensation paid to him or to another person, corporation, or other organization.
In a civil action brought against a health care professional, the court, in its discretion, may award to the health care professional prevailing under the provisions of this section reasonable attorney's fees to be taxed as court costs."
SECTION 2. This act takes effect upon approval by the Governor.
