A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 20-3-240 SO AS TO PROVIDE THAT A COURT HAVING JURISDICTION IN A DIVORCE PROCEEDING AND RELATED MATTERS MAY ORDER COURT RECORDS IN THE PROCEEDING SEALED UPON THE MOTION OF A PARTY TO THE PROCEEDING AND TO PROHIBIT THE UNSEALING OF THE RECORDS EXCEPT WITH THE CONSENT OF ALL PARTIES TO THE PROCEEDING.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Article 1, Chapter 3, Title 10 of the 1976 Code is amended by adding:

"Section 20-3-240. A court having jurisdiction in a divorce proceeding and related matters, on the motion of a party to the proceeding, may seal court records in the proceeding. Once sealed, the records may not be unsealed except with the consent of all parties to the proceeding."

SECTION 2. This act takes effect upon approval by the Governor.
