TO AMEND SECTION 41-11-50, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE UNLAWFUL FAILING
TO PAY WAGES, SO AS TO MAKE THIS OFFENSE A FELONY AND INCREASE THE PENALTY FOR VIOLATIONS; AND TO AMEND SECTION 16-1-10, RELATING TO CRIMES WHICH ARE CLASSIFIED AS FELONIES, SO AS TO INCLUDE THIS OFFENSE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 41-11-50 of the 1976 Code is amended to read:
"Section 41-11-50. Any employer who, having the financial ability, over and above any lawful exemptions, to pay any wages due, shall wilfully and fraudulently fail fails or refuse refuses to pay such wages within the designated period set forth in this chapter after written demand therefor or who shall falsely and with intent to cheat an employee out of his wages deny denies the amount actually due shall be deemed is guilty of a misdemeanor felony and, upon conviction, shall must be fined not more less than five hundred three thousand dollars or imprisoned for not more less than ninety days one year. Each violation shall constitute constitutes a separate offense."
SECTION 2. The offense contained in Section 41-11-50 of the 1976 Code is added to the list of crimes which are classified as felonies under Section 16-1-10.
SECTION 3. This act takes effect upon approval by the Governor.
