TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-1-280 SO AS TO PROVIDE FOR THE CREATION OF THE DIVISION OF NATURAL RESOURCES POLICE OF THE SOUTH CAROLINA WILDLIFE AND MARINE RESOURCES DEPARTMENT FROM THE DIVISIONS OF LAW ENFORCEMENT AND BOATING.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 50-1-280. (A) The Division of Law Enforcement and the Division of Boating of the South Carolina Wildlife and Marine Resources Department are combined and known as the Division of Natural Resources Police of the South Carolina Wildlife and Marine Resources Department.
(B) The mission of the division is consistent with that of its predecessors, and it shall continue to provide support to other law enforcement agencies and divisions.
(C) The division's organizational structure remains intact. It has its own budget and continues to receive funding from all state, federal, and revenue sources currently utilized. If additional funding is available, it is not in lieu of current funding.
(D) The officers of the division are designated as `State Natural Resources Police' and must be recognized as being equal to and having parity with other state law enforcement officers including, but not limited to, officers of the South Carolina Law Enforcement Division and the South Carolina Highway Patrol with regard to benefits, compensation, retirement, and disability provisions."
SECTION 2. The South Carolina Code Commissioner, when appropriate, shall change references from the Division of Law Enforcement and the Division of Boating of the South Carolina Wildlife and Marine Resources Department to the Division of Natural Resources Police of the South Carolina Wildlife and Marine Resources Department.
SECTION 3. This act takes effect upon approval by the Governor.
