TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-23-435 SO AS TO PROVIDE THAT IT IS UNLAWFUL FOR A PERSON UNDER TWENTY-ONE YEARS OF AGE TO POSSESS A WEAPON ON SCHOOL PROPERTY OR ON A COLLEGE OR UNIVERSITY CAMPUS AND TO PROVIDE PENALTIES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 16-23-435. (A) It is unlawful for a person under the age of twenty-one to carry on his person a firearm (rifle, shotgun, pistol, or similar device that propels a projectile through the energy of an explosive), a knife, a blackjack, a metal pipe or pole, or any other type of device or object which may be used to inflict bodily injury or death while on the property of an elementary, middle, secondary, college, university, or technical school in this State or while attending an activity or event sponsored by one of these institutions.
(B) A person who violates the provisions of this section is guilty of a misdemeanor and, upon conviction, must be imprisoned for a mandatory term of one year. The one-year mandatory term may not be suspended or reduced. In addition to the imprisonment, upon conviction, the person must be permanently expelled from any school, college, or university."
SECTION 2. This act takes effect upon approval by the Governor.
