House Bill 4397 amends the South Carolina Code of Laws, 1976, by adding Section 24-1-290 so as to prohibit the Department of Corrections from providing or promoting exercise equipment for use by prisoners.
If this bill is approved, the estimated fiscal impact to the General Fund of the State should be nominal.

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 24-1-290 SO AS TO PROHIBIT THE DEPARTMENT OF CORRECTIONS FROM PROVIDING OR PERMITTING EXERCISE EQUIPMENT FOR USE BY PRISONERS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 24-1-290. The department may not provide or permit exercise equipment for use by prisoners. For purposes of this section `exercise equipment' means free weights and machines or devices that are designed for exercising parts of the human body by offering various amounts of resistance."
SECTION 2. This act takes effect upon approval by the Governor.
