A BILL

TO AMEND SECTION 56-5-1530, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO ALTERATION OF SPEED LIMITS IN THE STATE HIGHWAY SYSTEM BY THE DEPARTMENT SO AS TO PROVIDE FOR A REDUCED MAXIMUM SPEED LIMIT FOR COMMERCIAL MOTOR VEHICLES AS DEFINED IN SECTION 56-1-2030(6).

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 56-5-1530 of the 1976 Code is amended by adding an Item (c) to read:

"(c) Notwithstanding any other provision of law, the department must establish a maximum speed limit on each street or highway in the state highway system for commercial motor vehicles, as defined in Section 56-1-2030(6), which is five miles per hour lower than the maximum posted speed limits established for other non-commercial motor vehicles. The maximum posted speed limit for commercial motor vehicles is effective at all times when appropriate official signs giving notice thereof are erected upon such street or highway. The department shall modify existing official speed limit signs or erect other such official signs as deemed appropriate to give notice of the lower maximum speed limits to individuals operating commercial motor vehicles in this State."

SECTION 2. This act takes effect upon approval by the Governor.
