TO AMEND SECTION 9-1-470, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO ADMISSION OF POLITICAL SUBDIVISIONS TO THE STATE RETIREMENT SYSTEM, SO AS TO PROVIDE THAT AN EMPLOYEE OF A POLITICAL SUBDIVISION MAY JOIN THE SYSTEM WHETHER THE EMPLOYER IS ADMITTED IF ALL CONTRIBUTIONS ARE PAID BY THE EMPLOYEE AND OTHER REQUIREMENTS ARE MET.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 9-1-470 of the 1976 Code, as last amended by Act 555 of 1988, is further amended to read:
"Section 9-1-470. (A) Any A county, municipality, or other political subdivision of the State, any an agency or department of them, including a school board, any a service organization as defined in Section 9-1-10(4), and any a nonprofit corporation created under the provisions of Chapter 35 of Title 33, for the purpose of supplying water and sewer, may, in its discretion, become an employer by applying to the board for admission to the system and by complying with the requirements and the regulations of the board.
(B) Notwithstanding any other provision of law, a person employed by a county, municipality, other political subdivision of the State, an agency or department of them, including a school board, a service organization as defined in Section 9-1-10(4), and a nonprofit corporation created under Chapter 35 of Title 33 for the purpose of supplying water and sewer may purchase membership in the system whether or not the person's employer has been admitted to the system if the person pays the employer and employee shares of retirement contributions and meets other requirements as may be prescribed by the board in regulation. The board shall promulgate regulations specifying the procedure and requirements for admission of persons to the system pursuant to this subsection."
SECTION 2. This act takes effect upon approval by the Governor.
