The House assembled at 12:00 Noon.

Deliberations were opened with prayer by the Chaplain of the House of Representatives, the Rev. Dr. Alton C. Clark as follows:

Lord God, as we return to our weekly routine, we pray for people throughout the world: for those that prosper that they may give thanks to You; for those that struggle that they might not hope in vain; for the poor that they might have enough to live; and for all people that they might know God. Give us the vision to see all creation as a gift of Your never-failing love and to receive it with gratitude and to use it aright.

Accept, Heavenly Father, our unending praise and thanksgiving for all Your blessings to us. Amen.

Pursuant to Rule 6.3, the House of Representatives was led in the Pledge of Allegiance to the Flag of the United States of America by the SPEAKER.

After corrections to the Journal of the proceedings of Friday, the SPEAKER ordered it confirmed.

MOTION ADOPTED

Rep. CROMER moved that when the House adjourns, it adjourn in memory of Mr. Tony Gallant of East Columbia, which was agreed to.

Dear Mr. Speaker and Members of the House:

I am hereby returning without my approval H. 3200, R-280, an Act:
TO REPEAL SECTION 50-17-670, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO REGISTRATION NUMBERS ON LICENSED SHRIMP TRAWLERS; AND TO AMEND SECTION 50-17- 105, RELATING TO THE PROHIBITION ON THE DISPLAY OF DOLPHINS AND WHALES, SO AS TO DELETE THE PROHIBITION AND PROVIDE CIRCUMSTANCES UNDER WHICH IT IS LAWFUL TO DISPLAY DOLPHINS AND WHALES.
My veto is based on significant concerns that I have regarding this legislation, concerns which I believe to be shared by many members of the General Assembly. First and foremost, I am concerned that this bill may have failed to receive the benefit of a full and fair hearing during the legislative process. Specifically, H. 3200, when introduced, served only to repeal Section 50-17-670 of the South Carolina Code of Laws, "RELATING TO REGISTRATION NUMBERS ON LICENSED SHRIMP TRAWLERS." After this bill had received three readings in the House and two readings in the Senate, an unrelated amendment was added effecting a repeal of our state's prohibition on the public display of dolphins and whales. This amendment was attached in a legislative maneuver that caught many legislators by surprise. In fact, it appears that many votes were cast for this bill by those who were not fully aware of its contents.

South Carolina's marine mammal protection law, which prohibits the public display of dolphins or whales, serves a valuable purpose. By enacting this forward-thinking legislation, we have taken a strong stand against the inhumane treatment of marine mammals, and I will not sign a bill which would repeal our marine mammal protection law without a specific reason, particularly when it appears that this bill failed to have been fully and fairly debated in the legislature.

I have been contacted by several individuals who said there may be plans to construct a large marine center, tied to education and research, in South Carolina that could also operate to rescue and rehabilitate beached or injured marine mammals. However, I have since found no substance to these reports. If such a center is proposed, the General Assembly could adopt some language with these more specific circumstances in mind, then there could be reason to reconsider this issue. However, language in this legislation is not that language, and for this reason and other concerns which I have I am returning H. 3200, R-280 to you without my signature.

Whereas, the Richland Northeast High School "Cavaliers" Football Team of Richland County recently captured the Class AAAA, Division II State Football Championship for 1993; and

Whereas, the "Cavaliers" won a hard fought overtime victory against previously undefeated Hartsville by a score of 30 to 24; and

Whereas, this fantastic come-from-behind victory crowned the unbelievable 1993 season with a heart-stopping interception by sophomore linebacker Ryan Kendall which secured the win; and

Whereas, led by its fine Head Coach Joe Wingard, the team arose to the occasion with its tough perseverance; and

Whereas, the Richland Northeast Football Team has added another chapter in its rich school history epitomized by its never-say-quit attitude. Now, therefore,

Be it resolved by the House of Representatives:

That the House of Representatives of the State of South Carolina, by this resolution, congratulates the Richland Northeast "Cavaliers" Football Team of Richland County on winning the Class AAAA, Division II State Football Championship.

Be it further resolved that the team and its coaches be granted the privilege of the floor of the House of Representatives at a time to be determined by the Speaker on Wednesday, January 26, 1994, for the purpose of being recognized and congratulated.

Be it further resolved that copies of this resolution be forwarded to Joe Wingard, Head Coach and to Ron Hill, Principal of Richland Northeast High School.

The Resolution was adopted.

CONCURRENT RESOLUTION

S. 1013 -- Senator Mitchell: A CONCURRENT RESOLUTION TO CONGRATULATE MISS KIMBERLY AIKEN OF COLUMBIA UPON BEING CHOSEN MISS AMERICA 1994 AND TO EXTEND AN INVITATION TO MISS AIKEN TO ADDRESS A JOINT SESSION OF THE GENERAL ASSEMBLY AT 10:30 A.M. ON THURSDAY, MARCH 3, 1994.

Whereas, Miss Kimberly Aiken of Columbia competed in the Miss South Carolina Pageant; and

Whereas, Miss Aiken competed against many other young talented women representing areas of the State; and

Whereas, in July, 1993, Miss Aiken was selected by a panel of judges chosen from across the country to serve as Miss South Carolina and represent the State in the Miss America Pageant; and

Whereas, the eighteen-year-old Columbia native is the daughter of Charles and Valerie Aiken; and

Whereas, she is a graduate of Columbia High School and a sophomore at the University of South Carolina; and

Whereas, Miss Aiken is the first African American chosen to represent the State of South Carolina; and

Whereas, Miss Aiken has represented the State well with her poise, grace, talent, humility, and spirit of dedicated service to mankind; and

Whereas, Miss Aiken founded the Homeless Education and Resource Organization (HERO) to provide education and assistance to help homeless people help themselves; and

Whereas, she competed against forty-nine other women representing their states and exuded beauty, confidence, maturity, intelligence, and talent; and

Whereas, her rendition of "Summertime" from Porgy and Bess during the talent segment received applause from halfway through the selection; and

Whereas, her beauty, grace and poise were evident throughout the evening during the physical fitness and evening gown portions; and

Whereas, her dedication to helping others and her intelligence was demonstrated to the judges during the interview segment; and

Whereas, on September 18, 1993, in Atlantic City, Miss Aiken was the judges' choice for a modern Miss America; and

Whereas, she is the fifth African American to have the honor and distinction to wear the jeweled tiara representing Miss America; and

Whereas, she is the first Miss South Carolina to become Miss America since 1957; and

Whereas, she has overcome the biases against her displayed by her own fellow South Carolinians; and

Whereas, this State could benefit from her goals; and

Whereas, the members of the General Assembly want to hear her speak on the issues confronting her and the State and want to invite her to speak to a joint session at her convenience and at the convenience of the Speaker of the House and the President of the Senate. Now, therefore,

Be it resolved by the Senate, the House of Representatives concurring:

That the members of the General Assembly congratulate Miss Kimberly Aiken of Columbia upon being chosen Miss America 1994 and invite her to address a joint session of the General Assembly at 10:30 A.M. on Thursday, March 3, 1994.

Be it further resolved that a copy of this resolution be forwarded to Miss America 1994, Kimberly Aiken; Mr. and Mrs. Charles Aiken, her parents; Mr. Joe Sanders, Executive Director of the Miss South Carolina Pageant and the President of the National Association of Miss America State Pageants.
