The Senate assembled at 11:00 A.M., the hour to which it stood adjourned and was called to order by the PRESIDENT.

Our kind and loving Heavenly Father, we are so grateful to You for the privilege of serving our people. We ask Thy guidance and help us to make good decisions. This morning we ask God to be with Chaplain Meetze and Mrs. Meetze who's in such bad shape physically, we pray for Senator SETZLER and his mother as he sits by her bed in such a serious condition. We ask You to be with "Duby" Thompson's family as they bury him today. Let them all feel Your love and strength and forgive us of our sins, please, Sir. In Christ's sake. Amen.

/SECTION 1. The 1976 Code is amended by adding:

"Section 38-71-737. (A) An offer to sell a group health insurance policy must include an offer of an optional rider or endorsement to provide benefits for psychiatric conditions as defined in this section. The offer of coverage may contain provisions prescribing different benefits for psychiatric conditions and physical conditions with respect to any deductible amount, coinsurance provision, or contract term affecting benefit determinations based upon use or nonuse of preferred providers.

(B) The offer of an optional rider or endorsement for a group health insurance policy must provide minimum benefits for psychiatric conditions not less than two thousand dollars for each member for each benefit year with a lifetime maximum benefit of ten thousand dollars.

(C) This section does not prohibit an insurer from issuing or continuing to issue a health insurance policy which provides benefits greater than the minimum benefits required by this section or benefits generally more favorable to the insured than those required by this section.

(D) As used in this section, `psychiatric conditions' means those mental and nervous conditions, drug and substance addiction or abuse, alcoholism, or other conditions that are defined, described, or classified as psychiatric disorders or conditions in the most current publication of the American Psychiatric Association entitled `The Diagnostic and Statistical Manual of Mental Disorders'."

SECTION 2. This act takes effect upon approval by the Governor./

Michigan may have his refund reduced for the payment of any attorney fees resulting from the settlement of the cases of Bass v. The State of South Carolina and Perri v. The State of South Carolina. The State of South Carolina shall pay attorneys' fees awarded in those cases in addition to the amount of the settlement.

In the case of Perri, the plaintiffs shall be reimbursed pro rata for any attorneys' fees paid from the Insurance Reserve Fund. In the case of Bass, the plaintiffs shall not have any refund payment reduced by the attorney fees incurred. The State through the Budget and Control Board shall negotiate with plaintiffs' counsel in Bass regarding attorneys' fees and after this negotiated fee is approved by the court, the fees shall be remitted by the State from the Insurance Reserve Fund. /
