A BILL

TO AMEND CHAPTER 8 OF TITLE 27 OF THE CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO CONSERVATION EASEMENTS, BY ADDING SECTION 27-8-90 SO AS TO PROVIDE FOR THE DONATION OF TEMPORARY PUBLIC RECREATION ACCESS EASEMENTS TO THE STATE BY PRIVATE LAND OWNERS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Chapter 8 of Title 27 of the 1976 Code is amended by adding:

"Section 27-8-90. An agency of state government may accept from a private individual a donation of an easement of less than permanent status to provide public recreational access to private property, provided that such easement fulfills the objectives of the agency. Accidents on land subject to a public access recreation easement and resulting from the public recreational use shall be subject to the South Carolina Tort Claims Act and the private landowner shall be held harmless by the South Carolina Insurance Reserve Fund. The value of the property subject to a public access recreation easement shall be reduced by an amount equal to the value of such easement when property is assessed and taxed by units of local government."

SECTION 2. This act takes effect upon approval by the Governor.
