A BILL

TO AMEND SECTION 12-27-1320, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO CONTRACT OBJECTIVES FOR BUSINESSES OWNED AND CONTROLLED BY SOCIALLY AND ECONOMICALLY DISADVANTAGED INDIVIDUALS AND FEMALES, SO AS TO PROVIDE THAT THE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION MAY NOT INCLUDE MATERIALS AND SUPPLIES UNDER CONTRACTS IN DETERMINING THE SET-ASIDE EXPENDITURES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 12-27-1320(M) of the 1976 Code is amended to read:

"(M) Any contracts awarded through the normal bid process to certified MBEs or WBEs may count toward the set-asides. Subcontracts entered into between prime contractors and certified MBE/WBEs without regard to these provisions may be counted toward the set-asides outlined in subsection (A) of this section if these subcontracts are verified through the department records. The department may not count the materials and supplies required under these contracts toward the set-asides unless obtained from a DBE regular dealer or a DBE manufacturer. DBE regular dealers and DBE manufacturers must be certified by the department."

SECTION 2. This act takes effect upon approval by the Governor.
