TO AMEND SECTION 56-3-20, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO DEFINITIONS, SO AS TO DEFINE `MOTOR VEHICLE'; TO AMEND SECTION 56-3-130, RELATING TO CERTAIN EXEMPTIONS FROM REGISTRATION, SO AS TO REQUIRE REGISTRATION OF BOAT TRAILERS UNDER TWENTY-FIVE HUNDRED; AND TO AMEND SECTION 56-3-700, RELATING TO THE REGISTRATION FEE FOR CERTAIN TRAILERS, SO AS TO REQUIRE THAT THE REGISTRATION FEE FOR BOAT AND LANDSCAPING TRAILER BE REMITTED TO THE COUNTY WHERE REGISTERED AND TO MANDATE THE PURPOSE FOR WHICH THESE FUNDS MAY BE EXPENDED.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 56-3-20(2) of the 1976 Code is amended to read:
"(2) `Motor vehicle': Every vehicle which is self-propelled on land and water, except mopeds, and every vehicle which is propelled by electric power obtained from overhead trolley wires, but not operated upon rails;"
SECTION 2. Section 56-3-130 of the 1976 Code is amended to read:
"Section 56-3-130. Boat trailers under twenty-five hundred pounds, farm Farm trailers and other utility trailers which are privately owned and not for hire need not be licensed or registered."
SECTION 3. Section 56-3-700 of the 1976 Code is amended to read:
"Section 56-3-700. (A) For every trailer, semitrailer, or pole trailer, the biennial registration fee is twenty dollars. The department must include in this classification every trailer, semitrailer, boat trailer or pole trailer designed for carrying property, except house trailers, and utility trailers, and boat trailers as otherwise provided in this article. Semitrailers or pole trailers weighing less than five hundred pounds with load capacity of less than one thousand pounds and trailers and semitrailers with an actual unloaded weight of fifteen hundred pounds or less and carrying a load capacity not exceeding twenty-five hundred pounds and which are designed, adapted, and used exclusively for agriculture, horticulture, or livestock-raising operations or for lifting or carrying an implement of husbandry need not be registered or licensed.
(B) Fees collected pursuant to this section from boat and landscapers' trailers shall be remitted to the general fund of the county of origin, which must be used for road maintenance purposes."
SECTION 4. This act takes effect upon approval by the Governor.
